Micro Talk 3 - Refusal to carry out an EHCP assessment

Run by SEND Education Advice Team at Skylarks
Skylarks offers a series of Micro Talks. These are small, online groups with a maximum of 5 families and a member of the SEND advice team. Please book early to be sent the link to the video call.

Micro talks focus on different aspects of the SEND processes with a format of

  • 20 - 30 mins of presentation.
  • 15 mins for general questions.
  • Discussion in more detail of individual cases.


This small group session will deliver advice around:

  • Responding to a Local Authority Decision not to carry out an assessment for an EHCP
  • The legal test that the LA should have applied.
  • What are the choices that you have in challenging this decision.
  • Working with the setting around what support they can provide.
  • What are the next steps.

Please only book on this session After you have received a decision letter from your local authority.

This decision letter should be received within 6 weeks of you or a setting requesting an EHCP. If you do not receive a decision after this time contact your local authority and remind them that they have to make a decision on the assessment request within 6 weeks.
